Terms of Service

These Terms of Service ("Terms") are an agreement between you and WarpDVR ("WarpDVR", "we", "us") governing your use of warpdvr.com, our APIs, and our desktop app (together, the "Service"). By accessing or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 13 years old (or older where required by local law) and able to form a binding contract. If you are under the age of majority, you confirm a parent or guardian agrees to these Terms. You sign in through Google or Discord and are responsible for all activity under your account and for keeping your credentials secure.

Beta service

The Service is in beta. Features may change, break, or be removed, and we may modify, limit, suspend, or discontinue any part of the Service (including storage limits, playback quality, or pricing) at any time, with or without notice.

Your content

You retain ownership of the content you upload ("Your Content"). You grant WarpDVR a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, transcode, modify (for example to trim, resize, or re-encode), display, and distribute Your Content in connection with operating, promoting, and improving the Service, including displaying content you make public or share by link. This license continues for a reasonable period after deletion as needed for backups and caches.

You represent that you own or have all necessary rights to Your Content and that it, and its use as described here, does not violate any law or the rights of any person, including copyright, privacy, and publicity rights. Content showing other people (for example in audio or video) is your responsibility.

Acceptable use

You agree not to:

• upload illegal, infringing, harassing, hateful, sexually explicit, or otherwise harmful content;
• violate any law, or the rights of others;
• scrape, probe, overload, reverse engineer, or attempt to gain unauthorized access to the Service;
• use the Service to distribute malware or spam, or to circumvent limits or security measures;
• impersonate others or misrepresent your affiliation.

We may review, remove, or restrict any content or account at our sole discretion, but we have no obligation to monitor content.

Copyright

We respond to notices of alleged infringement and may terminate repeat infringers. To report infringement, contact us (see below) with the material's location and details of your claim.

Feedback

If you give us suggestions or feedback, we may use them freely without obligation to you.

Third-party services

The Service relies on and links to third-party services (such as Google, Discord, and MultiGP). We are not responsible for them, and your use of them is subject to their terms. WarpDVR is not affiliated with MultiGP, HDZero, or other FPV companies unless stated.

Flying and safety

WarpDVR is a video hosting tool. We do not endorse or take responsibility for how any footage was recorded. Fly safely and legally. You are solely responsible for complying with aviation, privacy, and other laws.

Termination

You may stop using the Service and request deletion at any time (see our Data Deletion Policy). We may suspend or terminate your access or delete content at any time, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST. KEEP YOUR OWN COPIES OF ANYTHING IMPORTANT; WarpDVR is not a backup service.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARPDVR AND ITS OWNERS, OPERATORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, CONTENT, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS OR US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless WarpDVR and its owners, operators, and providers from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law.

Governing law and disputes

These Terms are governed by the laws of the United States and the state in which WarpDVR's operator resides, without regard to conflict-of-law rules. You agree that any dispute will be brought on an individual basis (not as a class or representative action) in the courts located in that state, and you consent to their jurisdiction.

Changes to these Terms

We may modify these Terms at any time. When we do, we will update the effective date above and may provide additional notice where appropriate. Changes take effect when posted. Your continued use of the Service after a change means you accept the updated Terms; if you do not agree, you must stop using the Service.

General

These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms; you may not without our consent.
